EDUCAUSE Merchandise Store Terms and Conditions

Welcome to the EDUCAUSE® merchandise store (the “Store”). These Terms and Conditions (“Terms”) govern your access to and use of the Store, including browsing the Store, purchasing merchandise, creating or using an account, submitting information, and interacting with any Store pages, features, or content.

The Store is made available by EDUCAUSE through Fourthwall, Inc. (“Fourthwall”), a third-party ecommerce, checkout, production, payment, fulfillment, and customer support platform.

Please read these Terms carefully. By accessing or using the Store, clicking “I accept,” placing an order, creating an account, or otherwise interacting with the Store, you agree that you have read, understood, and agree to be bound by these Terms, any additional Store policies posted or linked on the Store, EDUCAUSE’s applicable policies, and Fourthwall’s applicable terms and policies.

If you do not agree to these Terms, please do not use the Store.

1. Relationship Between EDUCAUSE, Fourthwall, and You

These Terms govern your use of the EDUCAUSE Store as an EDUCAUSE-branded website experience. They are between you and EDUCAUSE.

Fourthwall provides the platform and related services that support the Store, including ecommerce functionality, payment processing, production, order fulfillment, shipping, returns, exchanges, refunds, and order-related customer support. Product purchases, payment, fulfillment, shipping, returns, exchanges, refunds, and related transaction matters may also be governed by Fourthwall’s Merchandise Terms of Service, Privacy Policy, Returns & FAQ, and other policies presented or linked on the Store or during checkout.

If there is a conflict between these Terms and Fourthwall’s applicable terms regarding payment, checkout, order processing, taxes, shipping, fulfillment, returns, exchanges, refunds, or order support, Fourthwall’s applicable terms will control for those transaction and fulfillment matters.

2. About the Store

The Store offers EDUCAUSE-branded merchandise and related items, which may include apparel, accessories, drinkware, printed items, and other products selected or approved by EDUCAUSE.

Unless otherwise stated, products are offered for personal, noncommercial use. Purchase of merchandise does not create EDUCAUSE membership, event registration, sponsorship status, certification, endorsement, partnership, employment, or any other official relationship with EDUCAUSE.

EDUCAUSE may modify, add, remove, discontinue, or limit products or Store features at any time.

3. Eligibility

You may use the Store only if you are legally able to enter into a binding agreement and comply with these Terms and applicable law.

You must be at least 16 years old to use the Store. If you are under 18, you may use the Store only with the consent and involvement of a parent or legal guardian. EDUCAUSE may restrict access to or use of the Store if it determines that these eligibility requirements are not met.

If you use the Store on behalf of an organization, you represent that you are authorized to do so.

4. Accounts and Account Security

Some Store features may allow or require you to create an account or provide account information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information and to update it as needed. If you believe your account or order information has been compromised, please contact Store support promptly using the support contact provided on the Store.

EDUCAUSE and Fourthwall may suspend, restrict, or terminate access to an account or Store feature if they believe these Terms, Fourthwall’s policies, or applicable law have been violated.

5. Product Information and Availability

EDUCAUSE and Fourthwall make reasonable efforts to display product names, descriptions, images, colors, sizes, prices, and availability accurately. However, product details may vary, and images may not perfectly reflect the actual product due to differences in device displays, photography, production methods, printing processes, materials, sizing, or availability.

Products may be made to order. Availability, pricing, product specifications, and shipping options may change at any time without notice. EDUCAUSE and Fourthwall may correct errors, inaccuracies, or omissions and may modify, cancel, or refuse orders affected by such errors.

6. Orders, Payment, Taxes, and Authorization

By placing an order, you authorize Fourthwall and its payment processors to charge the payment method you provide for the total amount shown at checkout, including product costs, shipping and handling, taxes, duties, customs charges, and any other applicable fees.

All orders are subject to acceptance, availability, payment authorization, fraud-prevention review, and compliance with applicable law and platform policies. Fourthwall may decline, cancel, refund, or limit orders in accordance with its policies.

Prices are displayed on the Store and may change at any time. EDUCAUSE does not collect or store your full payment card information through the Store.

7. Shipping and Delivery

Shipping options, costs, delivery estimates, and carrier information are provided during checkout or through Fourthwall’s applicable shipping information. Delivery estimates are not guarantees.

Shipping times may vary based on production schedules, carrier performance, customs processing, destination, weather, holidays, address accuracy, and other factors outside EDUCAUSE’s control.

You are responsible for providing accurate and complete shipping information. EDUCAUSE and Fourthwall are not responsible for delays, failed delivery, loss, or additional costs caused by incorrect or incomplete information submitted with an order.

8. Returns, Exchanges, Refunds, and Damaged Products

Returns, exchanges, refunds, cancellations, and replacement requests are handled through Fourthwall’s applicable policies and customer support process.

Many items sold through the Store may be made to order. Because of this, returns or exchanges for non-defective products, including size preference, buyer’s remorse, or ordering the wrong item, may be limited or unavailable except as required by law or as permitted by Fourthwall’s policies.

If an item arrives damaged, defective, incorrect, or with a visible quality issue, please follow the support process provided on the Store or by Fourthwall. You may be asked to provide order information and clear photos of the product so the issue can be reviewed.

Unless Fourthwall’s posted policy provides otherwise, defective-product claims should be submitted within 30 days of purchase or within the time period stated in the applicable Fourthwall policy.

9. Promotions, Discounts, and Limited-Time Offers

EDUCAUSE or Fourthwall may offer promotions, discounts, limited-time items, or special offers. Such offers may be modified, suspended, or discontinued at any time and may be subject to additional terms, eligibility requirements, expiration dates, quantity limits, product exclusions, or geographic restrictions.

Unless expressly stated, promotional offers cannot be combined, transferred, redeemed for cash, or applied retroactively to prior purchases.

10. No Donations or Tax-Deductible Contributions

Purchases made through the Store are merchandise purchases and are not charitable donations. Unless EDUCAUSE expressly states otherwise in writing, amounts paid through the Store are not tax-deductible charitable contributions.

11. Ownership and Intellectual Property

The Store, EDUCAUSE-branded products, product designs, graphics, visual interfaces, text, images, logos, trademarks, trade dress, service marks, and other materials displayed on or through the Store are owned by EDUCAUSE, Fourthwall, or their respective licensors and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted by EDUCAUSE or applicable law, you may not copy, reproduce, distribute, modify, display, create derivative works from, sell, resell, license, exploit, or otherwise use any Store content, EDUCAUSE marks, EDUCAUSE designs, or EDUCAUSE-branded merchandise for commercial purposes.

The following are trademarks or service marks of EDUCAUSE, whether registered or unregistered, in the United States and/or other jurisdictions:

  • EDUCAUSE

  • EDUCAUSE Horizon Report®

  • EDUCAUSE Review®

  • EDUCAUSE Higher Ed Ready 2*** (™ pending)

Unauthorized use of any EDUCAUSE trademark is strictly prohibited.

EDUCAUSE should be written in all capital letters. Use of the EDUCAUSE name, logo, trademarks, service marks, trade dress, or other identifying marks is not permitted without prior written authorization from EDUCAUSE.

12. Limited License to Use the Store

Subject to your compliance with these Terms, EDUCAUSE grants you a limited, personal, nonexclusive, nontransferable, revocable license to access and use the Store for lawful, personal, noncommercial purposes.

You may not:

  • Reproduce, distribute, publicly display, or publicly perform the Store or its content except as permitted by law;

  • Modify, adapt, translate, reverse engineer, or create derivative works from the Store or its content;

  • Interfere with or circumvent any Store security, access control, checkout, payment, or technical feature;

  • Scrape, harvest, mine, or use automated tools to collect data from the Store without permission;

  • Use the Store in a way that could impair, damage, disable, overburden, or disrupt the Store or related services.

13. Feedback

If you submit ideas, suggestions, comments, corrections, product requests, or other feedback about the Store, EDUCAUSE merchandise, or related services, you grant EDUCAUSE permission to use that feedback for any lawful purpose without compensation or obligation to you. EDUCAUSE is not required to treat feedback as confidential.

14. Prohibited Conduct

You agree not to use the Store in any way that violates the EDUCAUSE Code of Conduct and:

  • Violates applicable law or regulation;

  • Is fraudulent, deceptive, abusive, defamatory, threatening, harassing, or harmful;

  • Infringes, misappropriates, or violates EDUCAUSE’s, Fourthwall’s, or any third party’s intellectual property, privacy, publicity, or other rights;

  • Misrepresents your identity, affiliation, endorsement, or relationship with EDUCAUSE;

  • Attempts to gain unauthorized access to accounts, systems, payment processes, or data;

  • Introduces malware, harmful code, or other disruptive technology;

  • Collects or shares personal, confidential, protected, or sensitive information without authorization;

  • Interferes with Store operations, security, or other users’ access to the Store;

  • Uses EDUCAUSE merchandise, trademarks, or Store content to suggest sponsorship, endorsement, approval, or affiliation where none exists.

EDUCAUSE and Fourthwall may take appropriate action in response to prohibited conduct, including refusing service, canceling orders, restricting access, removing content, or reporting activity to appropriate authorities.

15. Privacy

EDUCAUSE handles personal data in accordance with the EDUCAUSE Privacy Notice, as applicable. Fourthwall may also collect, process, and share personal information in connection with Store hosting, checkout, payment, fulfillment, shipping, customer support, analytics, security, fraud prevention, and related services.

By using the Store, you acknowledge that personal information may be processed by Fourthwall and its service providers as needed to operate the Store and fulfill orders. Please review both EDUCAUSE’s Privacy Notice and Fourthwall’s applicable privacy policy for more information.

16. Third-Party Services and Links

The Store may include links to or integrations with third-party websites, payment processors, carriers, tax providers, analytics tools, or support systems. EDUCAUSE does not control and is not responsible for third-party websites, services, policies, or practices.

Your use of third-party services may be governed by their own terms and privacy policies.

17. Accessibility

EDUCAUSE is committed to providing accessible digital experiences. If you experience difficulty accessing the Store or need assistance, please see EDUCAUSE web accessibility assistance.

Because the Store is hosted and operated through Fourthwall, some accessibility-related requests may need to be addressed by Fourthwall.

18. Disclaimer of Warranties

The Store and products are provided on an “as is” and “as available” basis, except as otherwise expressly stated by Fourthwall or required by law.

To the fullest extent permitted by law, EDUCAUSE disclaims all warranties, express or implied, regarding the Store and products, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

Some jurisdictions do not allow certain warranty limitations, so some of these limitations may not apply to you.

19. Limitation of Liability

To the fullest extent permitted by law, EDUCAUSE will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Store or purchase of products, including lost profits, lost data, business interruption, reputational harm, or inability to use the Store.

To the fullest extent permitted by law, EDUCAUSE’s total liability for any claim arising out of or related to the Store will not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Indemnification

You agree to defend, indemnify, and hold harmless EDUCAUSE, its officers, directors, employees, agents, representatives, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your misuse of the Store;

  • Your violation of these Terms;

  • Your violation of applicable law;

  • Your violation of any rights of another person or entity;

  • Your unauthorized use of EDUCAUSE intellectual property;

  • Any dispute between you and a third party related to your use of the Store.

21. Changes to the Store or These Terms

EDUCAUSE may update these Terms from time to time by posting revised Terms on the Store or otherwise making them available. The “Last updated” date will indicate when the Terms were most recently revised.

Your continued use of the Store after revised Terms are posted means you accept the revised Terms.

EDUCAUSE and Fourthwall may modify, suspend, or discontinue all or part of the Store at any time.

22. Additional Terms

Your use of the Store may be subject to additional terms, policies, rules, or guidelines posted on or linked from the Store, including Fourthwall’s Merchandise Terms of Service, Privacy Policy, Returns & FAQ, and Contact Support pages, and EDUCAUSE’s Terms and Conditions and Privacy Notice.

Those additional terms are incorporated into these Terms where applicable.

23. Miscellaneous

These Terms, together with any policies or additional terms expressly incorporated by reference, are the entire agreement between you and EDUCAUSE regarding your use of the Store.

If any part of these Terms is found invalid or unenforceable, that part will be enforced to the greatest extent permitted by law, and the remaining parts will remain in full force and effect.

EDUCAUSE’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later.

You may not assign or transfer these Terms or your rights under them without EDUCAUSE’s prior written consent. EDUCAUSE may assign these Terms as part of a merger, reorganization, transfer of operations, or similar transaction.

Section headings are for convenience only and do not affect interpretation.

24. Governing Law and Venue

These Terms are governed by the laws of XXX, without regard to conflict-of-law principles, except to the extent Fourthwall’s applicable terms govern specific transaction, payment, fulfillment, shipping, return, exchange, or refund matters.

Any dispute arising under these Terms will be resolved in the state or federal courts located in XXX  unless otherwise required by applicable law or Fourthwall’s applicable terms.
